March 12, 2009 - Attorney Datta and the AUSA's office have agreed to stay the case pending the outcome of the Gorovets case, which is also on hold.

December 12, 2008 - Surviving Spouse Sandra Elena Valero has filed a lawsuit in U.S. District Court for the Southern District of New York through her attorney Neal Datta, challenging her automatic denial due to the death of her American citizen husband. The case is Valero v. Chertoff, No. 08-10793 (S.D.N.Y. Dec. 12, 2008) and the case has been referred to Judge Loretta A. Preska, the Judge presiding over the Gorovets Litigation, as it is a potentially related case.
